You found the engineer. She lives in Porto. The company is four people in Austin plus two contractors in Pakistan, Gusto still runs US payroll, and the accountant just said international is outside her scope. The candidate wants a start date in three weeks. You do not have a Portuguese entity, you do not know whether this is an employee or a contractor, and you definitely do not know what happens if you guess wrong. That is not a global HR transformation. That is a founder staring at Slack at 11pm asking where to even start.
The quotes are already on Reddit. r/startups: “We’re about to hire our first international employee and I have no idea what I’m doing compliance wise.” r/digitalnomad: first employee in Portugal, no idea how to set it up. r/Payroll: “Gusto works early, Deel feels like overkill cost-wise, and DIY becomes chaos.” A Capterra Gusto reviewer said the quiet part: if Gusto worked across countries it would be unstoppable. It does not. Counsel wants a retainer for one question. The EOR quote is several hundred dollars per employee per month plus a month of salary on deposit.
Guessing is no longer cheap. Germany’s AUG fines start at EUR 60,000 per misclassified contractor. California can hit $25,000 per worker. The EU Platform Work Directive is in force. About 60 percent of multinationals still run some cross-border payroll on fragmented processes (Deloitte). Visas make it worse: a UK founder said SeedLegals spent years saying no to sponsored candidates because the licence was too much effort. - Pick the path — Contractor, local-entity employee, or EOR. Flag misclassification risk, visa or sponsor-licence work, and whether a one-month salary deposit will freeze working capital.
- Generate the country pack — Checklist, contract template, tax and benefit notes, 90-day reminder calendar. Templates are lawyer-reviewed per country; AI fills the role-specific bits, it does not invent the law.
- Stay DIY or hand off — DIY exports PDF plus a counsel-review queue. EOR path requests quotes from Remote, Deel, and RemoFirst and stores the comparison against the pack.

Cross-border hiring stopped being a perk. Remote.com surveyed 3,650 HR leaders: 73 percent expect more than half of new hires outside the home country by end of 2026. Four price tiers, one missing product. Premium EORs take the legal-employer seat. Budget EORs undercut them. AI-native EORs race on speed. Gusto plus a lawyer plus a spreadsheet is the status quo. Nobody sells a first-hire operating system that can recommend “don’t buy us, buy RemoFirst” and still get paid.

- Gusto — Incumbent until the first foreign hire, then a brick wall (Capterra). Assume it is already in the stack.

Do not fight Deel on AI compliance. Fight scope. They want $2,388 (RemoFirst) to $7,188 (Deel) per employee per year plus a salary deposit. One candidate in Portugal wants a path for this week.
